These Terms of Use ("Terms") govern your use of homes2gosa.com and any related pages, forms, and communications operated by Playa Enterprises, LLC, doing business as Homes2Go ("Homes2Go," "we," "us," or "our").

By using the Site, submitting a form, or responding to one of our ads, you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Site for your own non-commercial purposes of learning about and shopping for manufactured homes.

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Submit false, misleading, or someone else's information without their permission
  • Copy, scrape, harvest, or systematically download content or listings from the Site
  • Attempt to gain unauthorized access to the Site or any related systems
  • Interfere with or disrupt the Site, or introduce malware or harmful code
  • Use the Site to send unsolicited commercial messages

We may suspend or terminate your access at any time if we believe you have violated these Terms.

2. Homes, Pricing, and Availability

Information is subject to change. Home models, floor plans, specifications, features, photographs, square footage, lot availability, and prices shown on the Site are provided for general information only and are subject to change without notice. Inventory sells and manufacturer offerings change frequently.

Nothing on the Site is an offer to sell. Listings and prices on the Site are not offers, quotes, or contracts. A binding agreement is created only by a written purchase agreement signed by you and an authorized representative of Homes2Go.

Photographs and renderings are representative. Images, virtual tours, and renderings may show optional features, upgrades, décor, landscaping, or furnishings that are not included in the base price. Colors and finishes may vary. Square footage and dimensions are approximate and are typically measured from exterior wall to exterior wall.

Promotional offers. Advertised promotions, including any package, incentive, or "deal" pricing, are subject to availability, qualification requirements, stated time limits, and the specific terms disclosed at the time of the offer, and may be withdrawn or changed at any time.

Land and lot information. Where a home is advertised together with land or a lot, availability, lot dimensions, utilities, permitting, site preparation, and closing requirements are subject to verification and may affect final price and timing.

3. Financing Information

We are not a lender. Homes2Go does not make loans, does not issue credit decisions, and is not a mortgage broker. Any information on the Site about financing, loan programs, FHA Title I, chattel loans, down payments, monthly payments, interest rates, or qualification is general educational information only.

Not a commitment to lend. Nothing on the Site is a commitment, offer, or guarantee of financing, of a particular rate or payment, or of credit approval. All financing is subject to application, underwriting, and approval by the lender you choose, on that lender's terms.

Payment examples are illustrative. Any payment or rate example is for illustration only, is based on assumptions that may not apply to you, and does not include all costs such as taxes, insurance, delivery, site preparation, or fees.

We encourage you to shop around and compare offers from multiple lenders.

4. Trade-In Program

Any trade-in value, allowance, or estimate we discuss is preliminary and is subject to physical inspection, verification of ownership and title, lien payoff, and final written agreement. We may decline any trade-in.

5. Forms, Inquiries, and Contact Consent

When you submit a form or otherwise give us your contact information, you confirm the information is accurate and that you are the authorized user of the phone number and email address you provide.

You also agree that Homes2Go and those acting on our behalf may contact you by phone, text message, and email as described in our Privacy Policy, including by automated means. Consent to receive marketing calls or texts is not a condition of purchasing anything. You may opt out at any time by replying STOP to a text, using the unsubscribe link in an email, or contacting us directly.

Your use of the Site and the information you provide are also governed by our Privacy Policy.

6. Intellectual Property

The Site and its content, including text, graphics, logos, photographs, video, and layout, are owned by Homes2Go or our licensors and are protected by copyright, trademark, and other laws. "Homes2Go" and our logos are our marks. Manufacturer names and marks, including Cavco, Champion, Legacy, Oak Creek, and Marathon, belong to their respective owners and are used for identification purposes only. Their use does not imply endorsement by or affiliation with those manufacturers beyond our role as a retailer of their homes.

You may not use our content without our prior written permission, except that you may view and print pages for your personal, non-commercial use.

7. Third-Party Links and Services

The Site may link to third-party websites and services we do not control, including manufacturer sites, lender sites, mapping services, and social media platforms. We provide those links for convenience only. We are not responsible for third-party content, products, services, or privacy practices, and a link does not mean we endorse them.

8. Equal Housing Opportunity

Homes2Go is committed to equal housing opportunity and complies with the federal Fair Housing Act and applicable Texas fair housing law. We do not discriminate on the basis of race, color, religion, sex, familial status, national origin, disability, or any other protected characteristic.

9. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that information on the Site is complete, accurate, or current.

This section does not affect any written warranty provided with a home you purchase. Homes we sell may carry a manufacturer's warranty; those warranties are provided by the manufacturer on the manufacturer's terms, and this section does not limit your rights under them or under the Texas Occupations Code provisions applicable to manufactured housing.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMES2GO AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Homes2Go and its owners, officers, employees, and agents from any claims, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Bexar County, Texas, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted, and we will update the "Last updated" date above. Your continued use of the Site after changes are posted means you accept the revised Terms.

14. Miscellaneous

If any provision of these Terms is found unenforceable, the rest remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and Homes2Go regarding the Site.
